Quito, 19 marzo, 2018. Esta mañana Ángel Orna, vicepresidente del Colegio de Abogados de Pichincha y Jorge Piedra, presidente de la Federación de Estudiantes Secundarios del Ecuador, acudieron a la Fiscalía General del Estado al reconocimiento de rúbricas de la denuncia presentada por estas dos organizaciones sobre los casos de abusos sexuales contra el ex ministro Augusto Espinosa.

Orna sostuvo que la Fiscalía camina a pasos de tortuga, porque asegura que se ha realizado este llamado al reconocimiento de firmas después de tres meses de haber presentado la denuncia, razón por la cual le exige al fiscal Carlos Baca que actúe de inmediato.

Este jurista sostiene que se debe investigar al ex ministro por delitos de carácter penal, “más allá de lo que ha planteado la comisión AAMPETRA de la Asamblea Nacional que se de paso a juicio político, consideramos que el tema es de carácter penal: porque el Código Orgánico Integral Penal (COIP) en su artículo 272 de fraude procesal establece, que por no dar paso a las denuncias y ocultar los actos que no reconoció el 24 de octubre del año pasado en la comisión AAMPETRA respecto a que, él conocía de más de 100 casos de denuncias cada año; sin embargo,g únicamente se realizaron sanciones administrativas como cambio de sitio de trabajo o suspensión temporal, cuando los casos de abusos sexuales van más allá de eso; así también en el artículo 277 se establece por omisión de denuncia responsabilidad directa de los delitos en el funcionario público correspondiente”.

“El día de hoy hacemos este reconocimiento y exigimos a la Fiscalía que actúe más rápido y no a favor de un interés político, sino en nombre de la justicia frente a los miles de jóvenes y niños que fueron violados en las instituciones educativas, violaciones que fueron socapadas con el silencio de Espinosa. Los estudiantes rechazamos a todo aquel que improvise con nuestro futuro y juegue con nosotros” dijo Piedra.

A este reconocimiento también asistió Cesar Cárdenas, director del observatorio ciudadano de servicio público de Guayaquil, observatorio que hace acompañamiento a los padres de familia y abogados de los estudiantes afectados del colegio Aguirre Abad para que estos casos no queden en la impunidad.

Para Cárdenas, el ex ministro es el responsable no solo por omisión sino también por no haber denunciado estos hechos a su debido tiempo ante las autoridades respetivas: “este tipo de personas debe estar en la cárcel no merecen más que eso, porque la conmoción social que estos casos han provocado es irreparable”.

Estos representantes estarán a la espera de resultados concretos que en el mejor de los casos se pueden dar en un lapso de dos días si la Fiscalía actúa adecuadamente.
