Quienes abogan por la derogatoria de la Ley Orgánica de Comunicación (LOC) pretenden continuar monopolizando el derecho que todos los ciudadanos tenemos a comunicarnos. Se reclaman los representantes eternos de todos para el ejercicio de la libertad de prensa, a través de sus supuestos medios “imparciales”. Así se entiende que asambleístas como Lourdes Cuesta, de CREO, propongan una ley derogatoria a la actual LOC, que entrega la concesión de las frecuencias de radio y televisión a los monopolios privados, por 100 años.

Este proyecto ya se encuentra en la Comisión de Derechos Colectivos de la Asamblea; tiene apenas 11 artículos, que hacen declaratorias generales sobre las garantías que los medios deben tener para hacer y decir lo que quieran.

Es obvio que la LOC fue una de las piezas claves de la estrategia de acallamiento y obediencia que impuso el correísmo, pero no toda la Ley, sino solo una parte, que fue la que se usó desde el Estado para perseguir y sancionar. Asumimos, en ese sentido, la propuesta de reforma que surgió del Encuentro de Medios Comunitarios realizado en febrero en Ciespal: se debe eliminar la Superintendencia de Comunicación, y hacer que el Cordicom asuma las competencias reguladoras, pero integrado de diferente manera, con participación mayoritaria de ciudadanos y ciudadanas que no tengan intereses en el sector. Además, debería facilitarse, bajo acciones afirmativas, la concesión de frecuencias para medios comunitarios.

En la LOC actual existen artículos que contemplan derechos que los ecuatorianos no podemos dejar que nos los quiten, como la distribución equitativa de frecuencias para los tres sectores: público, privado y comunitario. Igualmente respecto de los principios de inclusión a sectores sociales vulnerables, el criterio intercultural en el tratamiento de los mensajes, la obligatoriedad de que las radioemisoras incluyan al menos el 50% de producción nacional en los espacios musicales, entre otros. Lo que se requiere es que más bien se fortalezcan estos derechos y se materialicen en serio.
